Duggan & Associates, PLLC
Commercial Financial Litigation
Commercial Financial Litigation at Duggan & Associates, PLLC is focused on the disciplined prosecution of B2B receivables in Texas courts.
We file and advance suits for breach of contract, account stated, suit on sworn account, and enforcement of personal and corporate guaranties, as well as secured claims governed by the Uniform Commercial Code.
From the outset, we evaluate venue and jurisdiction, prepare pleadings supported by admissible business records, and pursue prompt, verifiable service of process. Our posture is litigation-forward in every matter.

We develop the evidentiary record through targeted discovery, subpoenas, and depositions, and we use the rules of evidence to present business records affidavits and damages models that support the claim. Where the law and facts warrant, we seek early dispositive relief, including defaults and summary judgments, and we prepare cases for trial to obtain enforceable judgments. All filings and court appearances are handled with the precision and timeliness required by the Texas Rules of Civil Procedure and local rules.
To safeguard recovery, we employ lawful ancillary and post-judgment remedies. Depending on the record and statutory prerequisites, that may include applications for prejudgment attachment or sequestration, temporary restraining orders and injunctions to prevent asset dissipation, and, after judgment, writs of execution, non-wage garnishment where permitted, abstracts of judgment and judgment liens, turnover and receivership proceedings, charging orders, domestication of foreign judgments, and actions under Texas fraudulent transfer statutes. When supported by evidence, we also pursue alter-ego and veil-piercing theories to reach responsible parties.
Our practice is officered, documented, and conducted in court, not through informal collection activity. We adhere to all applicable federal and state laws, ethical rules, and court orders, and we communicate through proper legal channels.
If You Have Been Served
If you have been served in one of our cases, the matter is in active litigation and court deadlines apply. Parties should review the pleadings carefully and consult counsel regarding their rights and obligations.
